Kayla Diaz, a suspended Monmouth County correctional facility employee, will avoid jail time. According to New Jersey state court records, she was accepted into the Pretrial Intervention (PTI) program. The decision stems from charges filed after a brawl at the Tropicana casino in Atlantic City.
The PTI program is a diversion option that allows defendants without a serious criminal history to complete supervision and services instead of going through prosecution. If the program is successfully completed, the charges are typically dismissed.
Who is involved and what charges were filed
Investigators identified two main participants in the conflict. Kayla Diaz, 48, an employee of the Monmouth County Sheriff’s Office, was charged with aggravated assault and simple assault. The second defendant, 36-year-old Damian Pineiro, faced a broader list of offenses:
• aggravated assault,
• unlawful possession of a weapon,
• possession of a weapon for an unlawful purpose,
• terroristic threats.
Both were accepted into the pretrial intervention program in late August, as reflected in court records. For now, that means neither faces jail time.
The night at the Tropicana caught on video
The incident occurred in September of last year inside the Tropicana hotel and casino in Atlantic City. According to previously published reports, Diaz and Pineiro were accused of assaulting another couple. The conflict quickly escalated into a full-blown brawl, and it took the intervention of at least three members of the venue’s security staff to stop it.
Atlantic City police described Diaz’s actions in stark terms: according to law enforcement, she kicked the woman in the head several times, causing the victim to lose consciousness. The episode drew widespread attention after video of the altercation went viral on X thanks to a post by Barstool Sports.
Casino aggression fueled by adrenaline

Ten years on the job — and then a suspension
Kayla Diaz has held a position as a correctional facility employee with the Monmouth County Sheriff’s Office since 2014. After her arrest, she was suspended from performing her official duties.
The agency is reviewing the situation
Diaz’s employer launched an administrative review. Cynthia Scott, a spokesperson for the Monmouth County Sheriff’s Office, said: “After we became aware of the latest developments in her criminal case, we are conducting an administrative review to determine the appropriate next steps under civil service rules.” Scott also added that the agency is limited in what it can say at this stage.
What remains unclear
Court records reflect that Diaz and Pineiro were accepted into the pretrial intervention program, but no further details have been provided by the defense. At the same time, the employer is conducting its own administrative review, the results of which have not yet been announced. The terms and length of the PTI program for both defendants also have not been specified in the available records.
